Where will I find guidance on the roles of supervising and superintendent pharmacists?

A minimum of three years’ post-registration experience is required for both positions.
The supervising pharmacist of a Retail Pharmacy Business is the pharmacist in whole time charge of the carrying on of the business there, and is responsible for all operations of the pharmacy even when absent.
The superintendent pharmacist is in personal control of the management and administration of the sale and supply of medicines, and has overall control of the professional and clinical pharmacy policy.
While a pharmacist may only act as a supervising pharmacist in respect of one Retail Pharmacy Business, the superintendent may act in respect of more than one. In addition, the two roles may rest in the one person.
What are the declarations that pharmacy owners are required to make in the application for registration of a Retail Pharmacy Business?
All Retail Pharmacy Business Owners are required to complete and sign the declaration which includes the following:
• a declaration in respect of the nominated superintendent and supervising pharmacists
• a declaration that the sale and supply of medicinal products will be conducted under the personal supervision of a registered pharmacist at all times
• a declaration that the Retail Pharmacy Business will be conducted in compliance with Section 18 of the Pharmacy Act 2007 - the Regulation of Retail Pharmacy Businesses Regulations 2008 (Section 18 Regulations). Click here to view these regulations.
• a declaration that any change in ownership of the Retail Pharmacy Business will be immediately notified to the PSI (a change in ownership of a Retail Pharmacy Business cancels its registration).
• a declaration that all changes in registered pharmacist staff will be immediately notified to the PSI
• a declaration of satisfaction as to the identity, current registration status and competence of all pharmacists and pharmaceutical assistants named in this application
• a declaration that appropriate arrangements are established to ensure that all registered pharmacists employed can obtain and maintain appropriate experience and undertake continuing education (CE) and continuing professional development (CPD)
• a declaration to endeavour to ensure compliance with the Pharmacy Act 2007, including all Regulations, Code of Conduct, Statutory Rules and professional guidelines issued thereunder.
What maps and plans are required to be submitted with an application for registration of a Retail Pharmacy Business?
• A map of the location of the Retail Pharmacy Business
(If the pharmacy is in a shopping centre, please provide a map indicating where the shopping centre is in the locality and another map indicating the location of the pharmacy within the shopping centre)
(If the pharmacy is on a hospital campus, please provide a map of the location of the hospital pharmacy on the campus and another map indicating the location of the pharmacy within the hospital)
(If the pharmacy is in an urban area, town or village, please provide a map indicating the location of the pharmacy in the urban area, town or village)
• Floor plans of the Retail Pharmacy Business layout, indicating the dimensions of the dispensary and professional services areas etc. This plan should identify the dimensions of the area of the retail pharmacy business (in m2); identify the dimensions of the dispensary and the area in which pharmacist supervised medicines are stored (in m2) and clearly demarcate the dispensary/professional services and retail sections of the area.
• In preparing a map or sketch plan of the pharmacy, please note that these need not be professionally drawn. Hand-drawn maps or plans which are of reasonable quality and drawn to scale are acceptable.
What other documents are required to accompany an application for registration of a Retail Pharmacy Business?
In the case of a Retail Pharmacy Business which is owned by a company, a copy of:
(a) the Certificate of Incorporation;
(b) the Memorandum and Articles of Association, duly certified by the company’s accountants or solicitors.
All applications for registration should include evidence of the insurance or indemnity cover.
What are the fees for registering a Retail Pharmacy Business?
The fee to register a pharmacy as a Retail Pharmacy Business for 2009 is €2500.
The fee for registration of a new opening or change of ownership Retail Pharmacy Business has been set at €3500 for 2009.
Registration fees are tax deductable under the income tax code and they are chargeable against the profit of the enterprise.
How were the fees determined?
The registration fee was determined by the PSI Council, following an independent assessment of other regulated professional services and of the requirements to ensure the PSI fulfils its statutory obligations under the Pharmacy Act 2007, and approved by the Minister for Health and Children. The Pharmacy Act 2007 gives the PSI a broad regulatory remit and range of functions and duties. The PSI has a statutory responsibility for: the registration of pharmacists, pharmacies, pharmaceutical assistants. It has primary responsibility for inspection and enforcement of pharmacy law and secondary responsibility for enforcement of medicines law. It also has obligations under the Pharmacy Act 2007 in relation to accreditation, continuing professional development, the Code of Conduct for pharmacists and practice guidelines, public and patient information, complaints, the development of pharmacy education and the practice of pharmacy in Ireland.
What details about a registered Retail Pharmacy Business will be available on the public online register?
Following registration of the Retail Pharmacy Business, the following details will appear in the online public register on the PSI website:
• Name of Retail Pharmacy Business
• Address of Retail Pharmacy Business
• Registration Number of Retail Pharmacy Business
• Name of Pharmacy Owner, (and where the pharmacy owner is a company, the registered address of the company and CRO registration number)
• Name of Superintendent Pharmacist
• Name of Supervising Pharmacist
• Date of expiry of the Retail Pharmacy Business Certificate of Registration
What is the procedure now for opening a new pharmacy or when a pharmacy changes ownership?
Any person now wishing to open a new Retail Pharmacy Business must apply to register that Retail Pharmacy Business at least 60 days before it is opened and have that application processed (including inspection) and registered in accordance with statutory rules before it may operate.

A change in ownership of a Retail Pharmacy Business cancels its registration and the pharmacy owner must immediately notify the PSI of any such change. The new owner(s) must then apply for registration of the Retail Pharmacy Business as a new opening under the process outlined in the above Rules.
